{"id":4931,"date":"2014-01-03T01:05:40","date_gmt":"2014-01-03T01:05:40","guid":{"rendered":"https:\/\/luchadeclases.org.ve\/wp_temp\/?p=4931"},"modified":"2014-01-03T01:05:40","modified_gmt":"2014-01-03T01:05:40","slug":"solidaridad-trabajadores-abc","status":"publish","type":"post","link":"https:\/\/luchadeclases.com\/?p=4931","title":{"rendered":"Irreductible solidaridad con los trabajadores y trabajadoras de ABC Formas y Sistemas C.A."},"content":{"rendered":"<p style=\"text-align: justify;\"><img decoding=\"async\" style=\"float: right; margin-right: 12px; margin-left: 12px;\" src=\"http:\/\/www.aporrea.org\/imagenes\/2013\/12\/p1090356.jpg\" alt=\"\" width=\"250\" height=\"141\" \/>4\u00a0de diciembre de 2013.- Desde el diciembre pasado m\u00e1s de treinta trabajadores de la empresa ABC Formas y Sistemas no han podido llevar el sustento a sus familias por un cierre ilegal por parte de los hijos del antiguo due\u00f1o legal, fallecido en noviembre de 2012. Expresamos nuestro apoyo a estos compa\u00f1eros y compa\u00f1eras quienes han dado muestras de unidad y de tes\u00f3n al mantenerse en la f\u00e1brica, resguardando la infraestructura y las maquinarias de la misma, como no lo han hecho quienes los han dejado sin el sustento a ellos y sus familias. Es por ello que nos unimos a la exigencia de que el Ministerio del Trabajo emane la Resoluci\u00f3n que debe favorecer a los trabajadores y trabajadoras, atendiendo al art\u00edculo 149 de la LOTTT y a la petici\u00f3n de expropiaci\u00f3n ya en manos de los trabajadores.<\/p>\n<p>  <!--more-->  <\/p>\n<p style=\"text-align: justify;\">\u00abCabe destacar que el Art\u00edculo 149 de la LOTTT es claro y totalmente aplicable a la empresa ABC Formas y Sistemas C.A ya que los trabajadores y trabajadoras fueron v\u00edctimas de un cierre ilegal, fraudulento, los hijos e hipot\u00e9ticos herederos del antiguo patr\u00f3n legal ya fallecido Sr. Fabi\u00e1n Burbano, se han negado en reiteradas ocasiones a cumplir con la Providencia Administrativa que ordena el reinicio de las actividades productivas, el Ministro o Ministra del Poder Popular con competencia en materia de trabajo y seguridad social podr\u00e1, a solicitud de los trabajadores y trabajadoras, y mediante Resoluci\u00f3n motivada, ordenar la ocupaci\u00f3n de la entidad de trabajo cerrada y el reinicio de las actividades productivas, en protecci\u00f3n del proceso social de trabajo, de los trabajadores, las trabajadoras y sus familias. A tal efecto, convocar\u00e1 al patrono o patrona, trabajadores, trabajadoras y sus organizaciones sociales, para la instalaci\u00f3n de una Junta Administradora Especial, que tendr\u00e1 las facultades y atribuciones necesarias para garantizar el funcionamiento de la entidad de trabajo y la preservaci\u00f3n de los puestos de trabajo.
